These terms and conditions (“Terms”) govern your (“you” or “your") reservation for and participation in the Pessach holiday program (“Program”) at the Gomeh Hotel by Isrotel (“Hotel”) facilitated by Keter Travel Ltd. (“Keter” “us” or “we”). Please carefully review these Terms.

  1. Acceptance of these Terms.   By (i) confirming your reservation via email (or other electronic means of communication), (ii) providing Keter or the Hotel with credit card or billing information, (iii) signing a reservation form, (iv) making a deposit or other payment to Keter or the Hotel for the Program, or (v) participating in any portion of the Program or using the Hotel facilities, you accept and agree to be bound and abide by these Terms. If you do not agree to these Terms, do not take any such action.  In addition, any person declared by you as a member of your group in a reservation form or acting in any other manner as set forth above, and any guests invited by you to participate in any portion of the Program or use the Hotel facilities (“Group Member”), shall be deemed to have accepted these Terms and included for all purposes in any reference to “you” or “your” under these Terms. You are responsible to ensure that each Group Member complies with these Terms and for any action thereof.

  2. Reservation; Payment Terms 

    1. To secure your reservation for the Program, if you have not already done so, you will need to transfer the deposit in such amount (“Deposit”) and by such date as per the instructions in the separate confirmation email sent to you (“Confirmation Email”).  The balance of payment for the Program is due in accordance with the Confirmation Email. Any payments made by credit card will incur a 3% processing fee, which shall be further subject to the terms of the third party payment processor. Staff tips are not included in payment for the Program; we refer you to the Confirmation Email for suggested tips.

    2. All payments quoted do not include Value Added Tax (‘VAT’) and you will be responsible for VAT, as applicable, on all payments to Keter, the Hotel or any Vendor. If you are a not an Israeli citizen or resident, to receive an exemption on VAT payments, upon arrival to the Hotel, you must present to the Hotel, and subject to its confirmation, your foreign passport and B/2 Visa (or other applicable visa), and copies thereof. 

    3. Failure by you to make any payment in a timely manner will be deemed a material breach of these Terms and Keter may, in its sole discretion, cancel your reservation or participation in the Program (or any portion thereof).

  3. The Program.  Although each of our programs is different and unique, and you should refer to the brochure and Confirmation Email that is specific for your Program, Keter will generally include in the Program the following basic components:

    1. The best available standard room. Room upgrades (based on availability), single rooms, children (above double occupancy) and babies, may be subject to supplementary costs. Specific bed types should be requested at the time of booking and are based on availability. For a group reservation with multiple rooms, we will do our best to assign the rooms close to one another.

    2. Meals will be provided at the Hotel in accordance with your Confirmation Email. You will have daily access to the tea room of the Hotel including light refreshments based on availability (e.g., coffee/tea, soft drinks). The Hotel may provided extra services which are not included in the cost. We refer you to the Hotel’s website for more information on the Hotel and its services and its terms and conditions which, by accepting these Terms, you are deemed subject thereto.

  4. Additional Activities; Third-Party Vendors.  Keter may coordinate trips, transportation, guides, entertainment, programming, events, food and restaurant services, accommodations, rental facilities, and other services and activities, whether at the premises of the Hotel or elsewhere (“Additional Activities”), from independent suppliers or other third party vendors (“Vendors”). Any Additional Activities are based on availability and pre-registration is required. Except as expressly stated otherwise, the Additional Activities are not included in the cost of the Program and you will be charged additional fees for participating in such activities. Such Additional Activities are at your and your Group Members’ own risk.

  5. Relationship of the Parties.  Keter acts solely as a booking agent and a facilitator of the Program and is deemed to be acting as an agent on your behalf in coordinating and reserving the Hotel, Additional Activities and any other services or actions related to the Program.

  6. Liability; Insurance

    1. Neither Keter, nor any of its affiliates, shareholders, directors, officers, representatives, agents, employees, contractors or subcontractors (“Keter Indemnified Parties”), shall be liable for any claims, damage, injury (including bodily injury or death), theft, fee, expense, deviation, delay, curtailment or other inconvenience, or any other loss, caused to or suffered by you or your property or any Group Member or its property (“Loss”), by the act or omission of the Hotel, any Vendor or any other third party engaged by Keter in connection with the Program, and you and your Group Members release, waive, discharge, hold harmless, and agree to indemnify the Keter Indemnified Parties from any and all such Losses. In no event shall the Keter Indemnified Parties be liable for any inconsequential damages, including incidental or indirect damages, arising from these Terms, regardless of foreseeability or advisement of such damages. Without derogating from anything to the contrary herein, Keter’s maximum liability, for any reason whatsoever, will be limited to the actual amount paid by you to Keter for the Program.

    2. For clarity, (i) Keter is not liable for any Loss caused to you or your Group Members by any other person located at the Hotel or participating in any Additional Activities, including other participants in the Program, and (ii) you and your Group Members are responsible for your own conduct and any Losses caused by you and your Group Members to the Hotel, its staff, and any other person located at the Hotel or participating in any Additional Activities.

    3. You affirm that you have no medical conditions that would restrict you from participating in the Program, and that if you experience any medical issues while on the Program, you will seek medical treatment immediately. You understand and acknowledge that your participation in the Program may involve potential risk to bodily injury and you confirm that: (i) you and your Group Members are physically and mentally capable of participating in the Program, and are willingly and knowingly electing to participate, and (ii) you and your Group Members willingly and voluntarily assumes full responsibility for any such potential risk suffered thereby.

    4. Keter does not purchase and is not responsible to provide insurance coverage for you or your Group Members or for the adequacy of the insurance procured (if any) by the Hotel or any Vendor in your regard. You are advised to purchase your own medical, travel or other insurance as you may determine necessary for your participation in the Program. 

  7. Complaints; Refunds.   We will be happy to use our best efforts to initially assist to resolve any complaints that you may have concerning the Hotel or Vendors. That being said, Keter is not responsible for any actions or omissions of the Hotel and its staff, the Vendors, and any of the services provided thereby, or any incidents that occur during your stay. If we are not successful in resolving your complaints, you should direct such complaints to Hotel management or Vendor. Refunds, if any, will be processed directly by the Hotel or such Vendor and Keter is not responsible for resolving any related disputes. Your obligation to pay Keter for the Program and any other services hereunder are not conditioned on your satisfaction with the Program and you agree that payment will not be withheld, in whole or in part, due to your dissatisfaction.

  8. Cancellation Policy.  For any cancellation prior to March 1, 2025, you will be refunded 100% of the Deposit, and thereafter and until April 1, 2025, you will be refunded 50% of the Deposit. You will not be refunded for any cancellation after April 1, 2025. In the event that the Israel Home Front Command declares the Hotel premises a danger zone under attack which needs to be evacuated immediately prior to the commencement of the Program, the payment for the Program will be refunded in full. Notwithstanding the foregoing, if you seek a refund for which payment has been made to the Hotel, Vendor or other service provider, Keter will not refund you unless we first receive the refund from such service provider. Refunds are not available for any services provided but not utilized by you. You agree that any payment dispute which arises in connection with the Program should first be brought to the attention of Keter prior to formally disputing a charge with your credit card company.

  9. Force Majeure.  Keter will not be liable or responsible to you or your Group Members, nor be deemed to have defaulted under or breached these Terms, for any failure or delay in fulfilling or performing any term of these Terms, when and to the extent such failure or delay is caused by or results from the following force majeure events: (a) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, or national or regional emergency; (b) embargoes or blockades; (c) action by any governmental authority or requirements of law, government closure; or (d) fire, earthquake, flood, epidemic or pandemic (including Covid-19 and all administrative authorities restrictions regarding it), quarantine, public health crisis, accident, explosion, strike, disruption of airline service, US or Canadian State Department advisory against travel to a specific country, or other comparable emergency beyond the parties’ control.

  10. Dispute Resolution.  You agree that any legal dispute arising out of or in connection with these Terms or the subject matter thereof shall be submitted for arbitration in accordance with the Israeli Arbitration Law (1968) as then in effect. Any arbitration to be conducted shall be conducted by a single arbitrator chosen by the parties to the arbitration within ten (10) business days following the date of a written notice is sent to the other party, setting forth a description of the dispute.  If the the parties fail to agree upon the appointment of the arbitrator within said period, then the arbitrator shall be selected and appointed by the chairman of the Israeli Bar Association. The arbitration award shall be final and binding upon the parties for all purposes and shall preclude any further or other recourse to any court otherwise having jurisdiction.  Notwithstanding the foregoing, if either of the parties believes that it is entitled to any provisional measure or injunctive relief, such party shall be entitled to seek such measure or injunctive relief through civil action before the courts located in Tel Aviv, Israel.

  11. Data Protection. Keter is committed to protecting your personal data in accordance with applicable laws.

  12. Entire Agreement; Amendments.  Keter expressly reserves the right to amend and update these Terms at any time and in its sole discretion.  Each update and amendment to these Terms shall be posted on Keter’s website or sent to you via email, at which point the amended version of these Terms shall become the valid and binding version then in effect. You may not sell, assign, or transfer any of its rights or obligations hereunder, and any attempt to sell, assign, or transfer such rights or obligations without Keter’s prior written approval will be null and void and constitute a material breach of these Terms. These Terms and the Confirmation Email, constitute the entire agreement between the parties with respect to its subject matter and supersedes all prior and contemporaneous agreements, correspondence, understandings, negotiations, and discussions, whether oral or written, between the parties.
